CIVIL VERDICTS & SETTLEMENTS
JURY AWARDS CLIENT 35K AS A RESULT OF BOARD BEING NEGLIGENT
Our client recently achieved a significant victory against her condo Association, Port Bellaire No. 4 INC, with the Association and Board being found negligent in maintaining the condominium's roof and negligent in their duty to properly maintain and make available official records of the Association.
A Jury found the Association negligent and the Court ordered an injunction against the Association to hire an engineer to effectuate replacement or repair of the common element. This could have been avoided with proper maintenance and guidance from their previous experts, roofing contractors, and legal counsel. In addition, our client was awarded $35,000 in damages, underscoring the importance of holding negligent Boards and Associations accountable! This outcome not only provides our client with deserved compensation but also ensures future diligence in property conditions and safety throughout Southwest Florida.

MOTION TO DISMISS GRANTED
Our client was improperly charged with Violating a Domestic Injunction, which as a result deeply and profoundly affected his life. Based on the evidence provided, a dismiss was sought. The dismissal was subsequently granted after a showing that the State failed to meet it's burden of a prima facie case. The State additionally voiced no objection to the motion, further evidencing a lack of a good faith basis when filing the information. Accountability applies to the State Attorney's Office, and sometimes that is overlooked and neglected. This is case and point why having competent legal counsel matters in criminal cases!

This case was originally set for trial in December of 2024.
Our client was incorrectly charged with violating a Domestic Injunction and was the subject of prosecutorial oversight & possible neglect. After discovering that the information filed by the State Attorney's Office both included the incorrect date and failed to include a "to wit", a Motion for a statement of Particulars was sought and answered. After a deposition of the alleged victim, an alibi defense was discovered, which resulted in this case being dismissed. Yet another reason to make sure you never stop advocating for your rights!
